1. Introduction
Welcome to Financial Literacy Courses Malaysia 2025. These Terms of Use ("Terms") govern your access to and use of our website, services, applications, and other online products (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
Our Services are provided by Financial Literacy Malaysia Sdn Bhd, a company registered in Malaysia with registration number 202505123456, having its registered office at Level 30, Menara Prestige, 1 Jalan Pinang, 50450 Kuala Lumpur, Malaysia.
2. Account Registration
To access certain features of our Services, you may need to register for an account. When you register, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate your account if any information provided during registration or thereafter proves to be inaccurate, false, or outdated, or if you have violated these Terms or any applicable law.
3. Course Enrollment and Payment
Our Services include various financial literacy courses and educational content. By enrolling in a course, you agree to pay the specified fees according to the payment terms provided at the time of enrollment. All payments are processed through our secure payment gateway.
Course fees are non-refundable except as expressly stated in our Refund Policy. We reserve the right to change our course fees at any time, but changes will not affect courses for which you have already enrolled and paid.
Upon successful payment and enrollment, you will be granted access to the course materials for the specified duration. Access to course materials may not be shared with others and is intended solely for the registered user.
4. Intellectual Property Rights
All content, materials, and resources provided through our Services, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, software, and course materials (collectively, "Content"), are the property of Financial Literacy Malaysia Sdn Bhd or our content suppliers and are protected by Malaysian and international intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Content solely for your personal, non-commercial educational purposes. You may not:
- Reproduce, distribute, publicly display, or publicly perform any Content
- Modify or create derivative works based on any Content
- Use any Content for commercial purposes
- Remove any copyright, trademark, or other proprietary notices from any Content
- Transfer the Content to another person or "mirror" the Content on any other server
Any unauthorized use of our Content may violate copyright, trademark, and other applicable laws and could result in criminal or civil penalties.
5. User Conduct
In using our Services, you agree not to:
- Violate any applicable law or regulation
- Infringe the rights of any third party, including intellectual property rights
- Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
- Interfere with or disrupt the Services or servers or networks connected to the Services
- Attempt to gain unauthorized access to any portion of the Services or any other accounts, computer systems, or networks connected to the Services
- Use any robot, spider, scraper, or other automated means to access the Services for any purpose
- Harvest or collect email addresses or other contact information of other users from the Services
6. User-Generated Content
Our Services may allow you to post, submit, publish, display, or transmit content such as comments, feedback, and other materials (collectively, "User Content"). You retain ownership of any intellectual property rights that you hold in your User Content.
By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content in any and all media or distribution methods now known or later developed. This license authorizes us to make your User Content available to the rest of the world and to let others do the same.
You represent and warrant that:
- You own the User Content posted by you or have the right to grant the license set forth above
- Your User Content does not violate the privacy rights, publicity rights, copyright rights, contractual rights, or any other rights of any person or entity
We reserve the right to remove any User Content that violates these Terms or that we find objectionable for any reason, without prior notice.
7. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
- The Services will meet your requirements
- The Services will be uninterrupted, timely, secure, or error-free
- The results that may be obtained from the use of the Services will be accurate or reliable
- The quality of any products, services, information, or other material purchased or obtained by you through the Services will meet your expectations
Any material downloaded or otherwise obtained through the use of the Services is done at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FINANCIAL LITERACY MALAYSIA SDN BHD, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST SIX MONTHS, OR, IF GREATER, ONE HUNDRED MALAYSIAN RINGGIT (RM100).
THESE LIMITATIONS WILL APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Indemnification
You agree to indemnify, defend, and hold harmless Financial Literacy Malaysia Sdn Bhd, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:
- Your use of and access to the Services
- Your violation of any term of these Terms
- Your violation of any third-party right, including without limitation any copyright, property, or privacy right
- Any claim that your User Content caused damage to a third party
This defense and indemnification obligation will survive these Terms and your use of the Services.
10. Termination
We may terminate or suspend your access to all or part of the Services, without notice, for any conduct that we, in our sole discretion, believe is in violation of these Terms or is harmful to other users of the Services, to us, or to third parties, or for any other reason.
Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us at [email protected].
All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on our website and updating the "Last Updated" date at the top of these Terms.
Your continued use of the Services after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Services.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration in Kuala Lumpur, Malaysia, in accordance with the Arbitration Rules of the Asian International Arbitration Centre for the time being in force, which rules are deemed to be incorporated by reference in this clause.
The Tribunal shall consist of one arbitrator. The language of the arbitration shall be English.
